Terms of Service

1. Introduction

Welcome to TrailUP ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of the TrailUP trail running training platform ("Service"), including our website at trailup.run and the TrailUP web application.

TrailUP is operated by WEBSAP CONSULT OPERATIONAL S.R.L., a company registered in Romania. Where these Terms say "TrailUP", "we" or "us", they mean that company.

By accessing or using TrailUP, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

TrailUP provides personalized trail running training plans with structured weekly blocks, daily workouts, heart rate zone guidance, and progress tracking. The Service also includes integrations with third-party fitness platforms (Garmin, COROS, Suunto, Strava, Polar, Apple Watch) to sync workouts and activity data.

3. User Accounts

To use TrailUP, you must create an account using Google OAuth or email/password. You are responsible for:

  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Providing accurate and complete profile information

4. Training Plans Disclaimer

TrailUP training plans are generated based on established ultra-running methodology and your self-reported fitness data. They are not medical advice.

  • Always consult a healthcare professional before starting a new training program, especially for ultra-distance events
  • You are solely responsible for assessing your own fitness and ability to follow any training plan
  • Training plans are calibrated using the information you provide — inaccurate input may result in inappropriate training intensity
  • TrailUP does not guarantee specific race results or performance improvements

5. Assumption of Risk

Trail running and ultra-marathon training involve inherent risks including but not limited to:

  • Physical injury from workouts or training sessions
  • Health complications from exercise, including cardiovascular events
  • Injury from terrain, weather conditions, or environmental hazards

By using TrailUP, you acknowledge these risks and voluntarily assume full responsibility for your health and safety during training. You should consult a physician before beginning any training program.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or other users' data
  • Scrape, crawl, or automate access to the platform without written permission
  • Redistribute, resell, or commercially exploit training plans generated by TrailUP
  • Transmit malware, viruses, or any harmful code

7. Intellectual Property

All content, design, code, training plan methodologies, and algorithms within TrailUP are owned by TrailUP. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

Training plans generated for you are for your personal use only and may not be reproduced, redistributed, or sold.

8. Third-Party Integrations

TrailUP integrates with third-party fitness platforms. When you connect a platform:

  • You authorize TrailUP to access your data on that platform as described in our Privacy Policy
  • You remain subject to that platform's own terms of service and privacy policy
  • TrailUP is not responsible for the availability, accuracy, or policies of third-party platforms

9. Paid Subscriptions and Billing

Parts of the Service are available only with a paid subscription. Plans and prices are listed on our Pricing page.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you subscribe you also accept Paddle's Buyer Terms.

  • Free trial. New subscriptions start with a free month. You provide payment details at signup; the first charge happens when the trial ends unless you cancel before then.
  • Automatic renewal. Subscriptions renew at the end of each billing period — monthly or yearly — at the then-current price, until you cancel.
  • Cancellation. You may cancel at any time from your account. Cancellation takes effect at the end of the current paid period; you keep access until then.
  • Refunds. Refunds and money-back terms are set out in our Refund Policy.
  • Taxes. Prices are shown in US dollars. VAT or sales tax that applies in your country is added and shown at checkout before you pay.
  • Price changes. We may change prices. We will email you at least 30 days before a change takes effect, and it applies from your next renewal after that date.
  • Failed payments. If a renewal payment fails, Paddle retries it. If it keeps failing, paid features may be suspended until payment succeeds.
  • Promotional codes apply a discount or free period to a subscription. They have no cash value, cannot be resold, and may be limited to one use per person.
  • App store purchases. Subscriptions bought through an app store are billed, renewed, cancelled and refunded under that store's terms.

10. Limitation of Liability

To the maximum extent permitted by law:

  • TrailUP is provided "as is" without warranties of any kind
  • We are not responsible for injuries, health complications, or adverse effects resulting from following training plans
  • We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service
  • Our total liability shall not exceed the amount you have paid for the Service in the 12 months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless TrailUP and its affiliates from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or any injury sustained during training.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Deleting your account ends any paid subscription with effect from the end of the current period (see the Refund Policy). You may delete your account at any time by contacting us at contact@trailup.run.

13. Changes to Terms

We may update these Terms from time to time. We will notify registered users of significant changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Romania. Any disputes will be resolved through informal negotiation first, then through the competent courts of Romania.
